WHAT’S THE LATEST

On June 12, the Bureau of Industry and Security (BIS), part of the U.S. Department of Commerce, announced additional steel derivative products (mainly specific types of home appliances) subject to the 50% tariff under Section 232 of the Trade Expansion Act of 1962. 

The tariff on these additional products, assessed on the value of the steel content in each product, is effective for products that are entered for consumption, or withdrawn from warehouse for consumption, on or after June 23 at 12:01 a.m. ET.

WHAT WE KNOW

The BIS has added the following steel derivative products:

  • Combined refrigerator-freezers (HTSUS subheading 8418.10.00)
  • Small and large dryers (HTSUS subheadings 8451.21.00 and 8451.29.00)
  • Washing machines (HTSUS subheadings 8450.11.00 and 8450.20.00)
  • Dishwashers (HTSUS subheading 8422.11.00)
  • Chest and upright freezers (HTSUS subheadings 8418.30.00 and 8418.40.00)
  • Cooking stoves, ranges, and ovens (HTSUS subheading 8516.60.40)
  • Food waste disposals (HTSUS subheading 8509.80.20)
  • Welded wire rack (under statistical reporting number 9403.99.9020)

On June 3, President Trump signed a proclamation modifying previous executive orders to increase tariffs on steel and aluminum imports to the U.S. from 25% to 50%, excluding products of the United Kingdom, to which a 25% duty rate applies. 

Tariffs on all other HTSUS codes included in Annex I of Proclamation 10896 remain in effect.

WHAT'S NEXT?

SEKO advises importers to review the updated Annex to determine if their classifications are within scope of these orders and to evaluate appropriate mitigation strategies.

Utilization of HTS databases for imported products is critical to ensure clearance data elements are updated timely and accurately in a rapidly changing regulatory environment. As importers identify special provisions or strategies to mitigate tariffs, importers should work with their Customs Broker to ensure documents are completed in a compliant manner.
